PENGUIN BOOK CLUB – EXCLUSIVE READS OFFICIAL PROGRAM RULES
The Exclusive Reads Program (“Exclusive Reads”) is brought to you by Penguin Group (Canada). Exclusive Reads allows registered Penguin Book Club members the opportunity of being selected to receive and review advance reading copies (“ARCs”) of upcoming Penguin Group (Canada) books.
1. ELIGIBILITY & ENTRY
NO PURCHASE NECESSARY. Exclusive Reads is open to all Canadian residents over the age of 13 years, except the residents of the province of Québec, employees of Penguin Group (Canada), Pearson Canada Inc., and their respective subsidiaries, affiliates, distributors, dealers, advertising and promotion agencies, or members of their immediate families.
To enter, complete and submit the form on the Exclusive Reads page and select the ARCs you would like to receive. Only one entry per entrant per book is permitted. Multiple entries for the same book will be discarded. Entries become the property of Penguin Group (Canada) and will not be returned
Odds of being selected for a Penguin Book Club ARC are dependant on the number of entries received.
2. SELECTION AND NOTIFICATION OF RECIPIENTS
The random draw will be held for each ARC on the day specified on the Exclusive Reads page by employees of Penguin Group (Canada), whose decision is final. The recipients will be notified by e-mail. If we do not receive a response to our email within 7 days, a new winner will be chosen. The ARC is for the recipient’s own personal use and may not be sold.
Penguin Group (Canada) will request that the recipients answer a few questions about the ARC and send Penguin Group (Canada) a brief review of the ARC. The recipients have no obligation to respond to this request.
ARCs are not available for purchase, but their estimated value is approximately $20. ARCs available for the Program will be updated on a monthly basis, and can be substituted at the discretion of Penguin Group (Canada).
3. RELEASE
To be confirmed as a winner, the selected entrant must respond to the email notification sent by Penguin Group (Canada) within 7 days of the email being sent. The entrant’s reply via email shall constitute and confirm the entrant’s (i) eligibility for the Program and compliance with these Program Rules; (ii) acceptance of or participation in the prize as offered; (iii) release of the Penguin Group (Canada) and its parent company, subsidiaries, affiliates, employees, directors, officers, suppliers, agents, Penguin Group (Canada)s, and administrators (collectively, the “Releasees”), and the Jury from any and all liability for any loss, harm, damages, cost, or expense arising out of participation in this Program, participation in any Program-related activity or the acceptance, use, or misuse of any prize, including but not limited to costs, injuries, losses related to personal injuries, death, damage to, loss or destruction of property, rights of publicity or privacy, defamation, or portrayal in a false light, or from any and all claims of third parties arising therefrom; (iv) grant to the Penguin Group (Canada) the unrestricted right, in the Penguin Group (Canada)’s collective or individual discretion, to produce, reproduce, publish, broadcast, communicate by telecommunication, exhibit, distribute, adapt, and otherwise use or re-use the winner’s name, photograph, likeness, voice, biography, and winning letter entry, in any and all media now known or hereafter devised, in connection with the Program and the promotion and exploitation thereof; and (v) waiver of his/her moral rights in his/her winning entry.
In addition, recipients of ARCs who elect to submit reviews to Penguin Group (Canada) hereby grant Penguin Group (Canada) non-exclusive permission to use the recipient’s review of the ARC, his or her first name, and his or her city/town of residence, for purposes of advertising, promotion and publicity without additional compensation, except where prohibited by law. Penguin Group (Canada) reserves the right to edit such reviews for clarity or to use only excerpts of from them; however, Penguin Group (Canada) will not do so in a manner that alters the substance of the review. Penguin Group (Canada) has no obligation to publish a review.
4. INDEMNIFICATION BY ENTRANT
By entering the Exclusive Reads program, entrant releases and holds Releasees harmless from any and all liability for any injuries, loss, or damage of any kind to the entrant, Releasees or any other person, including personal injury, death, or property damage, resulting in whole or in part, directly or indirectly, from acceptance, possession, use or misuse of any prize, participation in this Program, any breach of these Program Rules, or in any prize-related activity. The entrant agrees to fully indemnify Releasees from any and all claims by third parties relating to the originality of the entrant’s letter entry and/or the right to reproduce the winning letter entry.
5. LIMITATION OF LIABILITY
Penguin Group (Canada) assumes no responsibility or liability for lost, late, stolen, misdirected, mutilated, or incomplete entries, notifications, responses, replies, or any Release. Penguin Group (Canada) is not responsible for any technical, hardware, software, or telephone failures of any kind, lost or unavailable network connections, or failed, incomplete, garbled, or deleted computer or network transmissions which may limit the ability to participate in the Program. Penguin Group (Canada) assumes no liability for injury or damage which may be caused directly or indirectly, in whole or in part, from downloading. Penguin Group (Canada) is not responsible for any incorrect or inaccurate information, whether caused by any of the equipment or programming associated with or used in the Program or by any technical or human error which may occur in the administration of the Program. The Penguin Group (Canada) assumes no responsibility or liability in the event that the Program cannot be conducted as planned for any reason, including those reasons beyond the control of the Penguin Group (Canada), such as tampering, unauthorized intervention, fraud, technical failures, or corruption of the administration, security, fairness, integrity, or proper conduct of this Program.
6. CONDUCT
By participating in the Exclusive Reads program, each entrant agrees to be bound by the Program Rules, which will be posted at the Program Website throughout the Program Period. Entrant further agrees to be bound by the decisions of the Penguin Group (Canada), which shall be final and binding on all entrants in all respects. The Penguin Group (Canada) reserves the right, in its sole discretion, to disqualify any entrant found to be: (a) violating the Program Rules; (b) tampering or attempting to tamper with the entry process; and/or (c) acting in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten, or harass any other person. The Penguin Group (Canada) reserves the right to amend, withdraw, or terminate the Program at any time without prior notice, subject to applicable law and the approval of the Régie des alcools, des courses et des jeux with respect to the province of Quebec.
7. PRIVACY / USE OF PERSONAL INFORMATION
By participating in the Program, the entrant: (a) grants to the Penguin Group (Canada) the right to use his/her name, mailing address, email address, and telephone number (“Personal Information”) for the purpose of administering the Program / Program, including but not limited to contacting and announcing the winners; and (b) acknowledges that the Penguin Group (Canada) may disclose his/her Personal Information to third-party agents and service providers in connection with any of the activities listed in point (a) above.
By accepting a prize in the Program, recipients grant to Penguin Group (Canada) the right to use his/her Personal Information and winning entry for the purposes of promoting Exclusive Read books, and for any publicity or promotional purposes relating to the Program, in any and all media now known or hereafter devised, including, but not limited to, publication online on any website, in print or on air, without further compensation, unless prohibited by law, and waives his/her moral rights in his/her winning entry. Winner acknowledges that the Penguin Group (Canada) may disclose his/her Personal Information to third-party agents and service providers of any of the Penguin Group (Canada) in connection with any of the activities listed above.
The Penguin Group (Canada) will use the entrant’s and winner’s Personal Information for the purposes identified above.
8. INTELLECTUAL PROPERTY
All intellectual property, including but not limited to trademarks, trade names, logos, designs, promotional materials, web pages, source code, drawings, illustrations, slogans, and representations are owned by the Penguin Group (Canada) and/or its affiliates. All rights are reserved. Unauthorized copying or use of any copyrighted material or intellectual property without the express written consent of its owner is strictly prohibited.
9. LAW
These are official Exclusive Reads Program Rules. This program is subject to applicable federal, provincial, and municipal laws and regulations. These program rules are subject to change without notice in order to comply with any applicable federal, provincial, and municipal laws or the policy of any other entity having jurisdiction over the Penguin Group (Canada). All issues and questions concerning the construction, validity, interpretation, and enforceability of the Program Rules or the rights and obligations as between the entrant and the Penguin Group (Canada) in connection with the Program shall be governed by and construed in accordance with the laws of the province of Ontario including procedural provisions without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of any other jurisdiction’s laws.
10. LANGUAGE DISCREPANCY
In the event of any discrepancy or inconsistency between the terms and conditions of the Exclusive Reads program rules and disclosures or other statements contained in any Exclusive Reads program-related materials, including but not limited to the Program entry form, or point of sale, television, print or online advertising, the terms and conditions of the Exclusive Reads program rules shall prevail, govern, and control. In the event of any discrepancy or inconsistency between the English language version and the French language version of the Exclusive Reads program rules, the English version shall prevail, govern, and control.

For a list of Exclusive Reads recipients, indicate the ARC title and dates it was featured on the Exclusive Reads page online, and a and send a self-addressed envelope bearing sufficient postage to:
